On January 1, 2023, the Connecticut Clean Slate Act took effect. The Act, which was updated on July 1, 2023, allows for the automatic erasure of certain convictions.

For convictions that occurred after January 1, 2000:

Most, but not all, misdemeanor convictions are erased "by operation of law" 7 years after the court entered the conviction.
Most, but not all, class D and E felonies and unclassified felonies with a maximum term of imprisonment of less than 5 years as well as most, but not all, DUIs are erased "by operation of law" 10 years after the court entered the conviction.

For convictions that occurred before January 1, 2000:

Most, but not all, misdemeanor convictions and most but not all class D and E felonies as well as unclassified felonies with a maximum term of imprisonment of less than 5 years shall be erased after the convicted person files a Petition for Clean Slate Erasure, Conviction Before 1/1/2000 (JD-CR-202). The petition must be filed in the court in which the conviction occurred.

Certain charges are excluded for the Clean Slate Act erasure. They include:

Family Violence Crimes
Nonviolent sexual offenses or sexually violent offenses
DUIs, if the person has another DUI conviction within 10 years of the prior conviction.
Any conviction for a violation of section section 29-33 , 53a-60a , 53a-60b , 53a-60c , 53a-61a , 53a-64bb , 53a-64cc , 53a-72a , 53a-90a , 53a-103a , 53a-181c , 53a-191 , 53a-196 , 53a-196d , 53a-196f , 53a-211 , 53a-212 , 53a-216 , 53a-217 , 53a-217a , 53a-217c , 53a-322 , 53a-323 , 54-251 , 54-252 , 54-253 or 54-254 or subdivision (1) of subsection (a) of section 53a-189a .

A person is not eligible for Clean Slate Act erasure until they:

Have completed any period of incarceration, parole, special parole, medical parole, compassionate parole, or transitional supervision for any conviction on or after January 1, 2000;
Have completed serving any period of probation for any crime with a conviction on or after January 1, 2000, and
Are not the subject of any pending criminal charges in Connecticut.

The Clean Slate Act also applies to misdemeanor convictions while a person was under 18 years of age if the person's conviction was before they turned 18 years of age and the offense occurred on or after January 1, 2000, and before July 1, 2012. Motor vehicle offenses and violations of 51-164r are excluded.

If a person, while under the age of 18, was convicted of a misdemeanor before January 1, 2000, such person may file a petition with the Superior Court at the location in which the conviction occurred and request an order of erasure.

Any person who has their convictions erased pursuant to the Clean Slate Act shall be deemed to have never been arrested for the crimes that were erased and may swear so under oath.

If your privilege to drive has been permanently revoked under Connecticut General Statutes §14–227a(g) because of a 3rd conviction for DUI you may still be eligible to petition the DMV to reverse that suspension or reduce the length of that suspension.

The process and procedure for reversing or reducing a lifetime license suspension can be found in Connecticut General Statutes § 14-111(i).

In order to apply for a reversal or reduction of a permanent license suspension a person must be at least two years from the date of the permanent revocation. (In practice the DMV prefers for there to be a longer period of time before they will grant the application.) In addition, a person must not have any other suspensions or outstanding obligations on their license and all the other conditions for reinstatement must be met before the application will be entertained.

To start the process and applicant must request a hearing before the Commissioner of the Department of Motor Vehicles for reversal or reduction of their permanent license revocation. This request must be sent in writing to the Department of Motor Vehicles and must state specifically the reasons why the applicant is entitled to the reversal or reduction. The Commissioner of the DMV shall consider each application and review each applicant’s driver’s record and then may grant a hearing. It is the Commissioner’s discretion whether to grant the hearing or not.

Once the DMV has received your written request for a hearing they will write back and provide a list of other obligations the applicant must meet in order for the application to be successful. The DMV will often require:

1) Proof that you have completed an operator retraining program;

2) A completed medical form (Form P- 142m) which a licensed doctor must complete on behalf of the applicant based on a personal examination that occurs within 90 days the application submission;

3) A completed Form P263 “Authorization for Reversal or Reduction of Suspension”; and

4) A copy of the applicant’s criminal history which can be obtained for a fee from the State Police after you have been fingerprinted at the local police department.

Once the DMV has the information they have requested they will send written notice of the date, time and location of the hearing. You are entitled to be represented by an attorney at the hearing. At the time of the hearing letters of recommendation and other documents in support of the petition will be accepted by the DMV and will be taken into consideration in their determination of whether the applicant has earned a reduction or reversal of their permanent revocation.

In order for the applicant to be successful in their request for a reversal or reduction of their permeant license suspension they must show that the reversal or reduction will not endanger the public safety or welfare. In order to show that the applicant must provide evidence that will include, but not be limited to:

In June, Governor Lamont signed into law An Act Concerning Responsible and Equitable Regulation of Adult-Use Cannabis. This sweeping act drastically changes how the State of Connecticut deals with possession and cultivation of Marijuana and even provides for the erasure of prior act Marijuana related criminal records.

A few of the new provisions of the law are below:

Beginning July 1, 2021 for adults over 21:

*it is legal to possess up to 1.5 ounces of Marijuana (or its equivalent) on your person and to possess up to 5 ounces (or its equivalent) locked in a container in the home, vehicle glove box or vehicle trunk.

* it is legal to possess less than 5 ounces on one's person or less than 8 ounces in a locked glove box or vehicle truck is decriminalized.

* a first offense of possessing more than 5 ounces on one's person or more than 8 ounces in one's locked glove box or locked vehicle trunk is decriminalized but a second offense is a class D Misdemeanor.

*possession of cannabis paraphernalia is legalized.

* odor of cannabis or burnt cannabis cannot be used as a basis to stop or search.

*possession or suspected possession of up to 5 ounces of cannabis is no longer allowed as a basis to stop or search.

* it is prohibited for state-legal cannabis possession or use from being grounds to revoke parole, special parole or probation except in certain circumstances.

Sometime after July 1, 2021 the Department of Consumer Protection can authorize producers to also produce cannabis for adult use.

Beginning October 1, 2021 medical marijuana patients who are least 18 can grow up to 3 mature and 3 immature cannabis plants in their homes.

Beginning July 1, 2022 individuals can petition for erasure of prior convictions for possession, drug paraphernalia, and sale and manufacture of 4 or few ounces of cannabis.

Beginning January 1, 2023 the new law provides for automatic erasure of convictions from January 1, 2000 through Sept 12, 2015 for possession of fewer than 4 ounces.

The law provides for a number of protections to prevent underage use including making it an A Misdemeanor for a person who is 23 or older to give or sell cannabis to someone who is under 21 and makes it a class A Misdemeanor for a cannabis establishment to sell products to anyone under the age of 21.

Possession of cannabis by individuals between the ages of 18 and 20 is a fine except that a second or subsequent charge of possession of 5 ounces or more of cannabis (or its equivalent) is a D Misdemeanor.

Possession of cannabis by individuals under the age of 18 ranges from a written warning for a 1st offense; to a mandatory youth services referral for a 2nd offense and finally to an adjudication as a delinquent in juvenile court for a 3rd or subsequent offense.

There is a 60 day loss of driver’s license for anyone under 21 convicted of possessing any amount of cannabis.

Cannabis and hemp smoking is prohibited in any place that prohibits tobacco under the Clean Indoors Act. The law also bans smoking and e-cigarette use in the workplace regardless of the number of employees.

Individuals with certain prior convictions are disqualified from owning a cannabis establishment.

Most new licenses will be granted by lottery and at least 50% of the new license will be given to social equity applicants.

Beginning July 1, 2023 60%-75% of the cannabis excise tax revenue will be directed to the Social Equity and Innovation Fund and can be used to promote social equity in relation to access to capital for business, funding workforce education and funding for community investments.

Covid-19 Vaccine Timeline Update

Connecticut has moved forward it's Covid-19 vaccine timeline! Everyone over 45 will be eligible on Friday March 19 and all residents 16 and older will be eligible on April 5, 2021. This moves forward the eligibility for the younger group by more than a month.

As of late last week Connecticut had administered more than 1.25 million doses of the Covid-19 vaccine. About one quarter of the state’s residents have now received at least one dose. More than half of residents aged 55 and older have received at least one dose.

Coronavirus Vaccine Phase 1b Expansion

Governor Lamont announced today that he has expanded the next phase of Coronavirus vaccines. The expanded group will include anyone over the age of 65 and anyone with a high risk health condition. The newly expanded Phase 1b will now include approximately 1.3 million Connecticut Residents. Eligibility within Phase 1b will be rolled out in waves.

Governor Ned Lamont issued Executive Order 9N today. It increases the fine for businesses that fail to comply with the State's Covid -19 protocols from $500 to $10,000.

On November 9, 2020 Governor Ned Lamont issued Executive Order 9L extending the expiration date of his previously issued coronavirus related Executive Orders. Specifically his Executive Orders issued on March 10, 2020 and September 1, 2020 have now been extended until February 9, 2021 unless they are terminated earlier. The orders were issued in response to the Covid-19 pandemic and the public health and civil preparedness emergencies in Connecticut. Any individual section of any order that is scheduled to expire on any specific date will still expire on that specific date. Any municipal, agency or department order that has not yet expired shall remain in effect until February 9, 2021.

Connecticut back to Phase 2.1 of Covid-19 protocol

Due to the increased spread of the coronavirus Governor Lamont has moved Connecticut back to Phase 2.1 of the Covid-19 protocol.

Under Phase 2.1 rules restaurants, entertainment and recreation and commercial venues will have a 10pm closing time 7 days a week. Restaurants, indoor performing arts theaters, graduations, religious gatherings and indoor recreation venues are capped at 50% capacity. Indoor and outdoor private social and recreational gatherings at private residences are capped at 10 people. Private, social and recreational gatherings at commercial venues are capped at 25 people. Personal services and libraries can still function at 75% capacity with additional precautions. Employees are encouraged to maximize telework whenever possible and residents over 65 are urged to stay home as much as possible.

These measures are intended to help curb the spread of Covid-19.

Jury Trials to Remain on Hold

The Connecticut Judicial Branch announced that it is delaying indefinitely plans to restart jury trials due to the continued spread of the Covid -19 virus. The Judicial Branch had initially targeted November 1st to restart jury trials which had been postponed since march 2020. Judicial says it will monitor the situation weekly and plans to restart jury trials as soon as practicable.

Judicial officials have postponed plans to resume jury trials in Connecticut state courts because of rising coronavirus rates.

Chief Justice Richard Robinson in September announced a proposal to have residents begin reporting for jury duty again on Nov. 2. Trials had been put on hold in March as the virus swept through the state.

The plan has been put on hold indefinitely and will be reassessed weekly, said Rhonda Stearley-Hebert, a spokesperson for the Judicial Branch, on Monday.

“While our goal has been to resume jury trials on Monday, Nov. 2, the recent increase in positive test results statewide has caused us to pause the process so we may continue to reassess what we can safely do under these challenging circumstances,” she said in a statement.

The latest 14-day average positivity rate in Connecticut is about 3%. State health departments are calculating positivity rate differently across the country, but for Connecticut, The Associated Press calculates the rate by dividing new cases by test specimens using data from The COVID Tracking Project from Oct. 15-29.

Gov. Ned Lamont’s office has said the number of cases has been rising steadily, including a one-day positive test rate of 6.1% on Thursday. Friday’s rate was back down to 2.5%. The rate had been below 1% over the summer.

Connecticut also continues to see an increase in hospitalizations and deaths. There were 329 people in the state hospitalized with COVID-19 on Friday, the most since early June. The state also reported seven more virus-related deaths Friday, bringing the state’s total during the pandemic to 4,616. More than 71,000 people in the state have tested positive.

State courts have been taking steps to resume jury trials, including installing protective barriers and acquiring adequate supplies of personal protective equipment, Stearley-Hebert said.

Executive Order 7000

On August 21 Governor Ned Lamont issued Executive Order 7000. The order extends the moratorium on residential evictions until October 1, 2020. There three exceptions to this moratorium. The exceptions are-

*nonpayment of rent due on or before February 29, 2020

*serious nuisance as defined in the Connecticut General Statues

*for a bona fide intention by the landlord to use the dwelling unit as the landlord's principal residence. (This exception only applies after the term of any rental agreement has expired.)

A notice to quit for nonpayment issued before October 1, 2020 must recite the period of time before February 29, 2020 for which the rent has not been paid.

All notices to quit issued before October 1, 2020 for the purpose of the landlord using the premises for his/her principal residence must state that reason and specify when the lease expired.

The State of Connecticut Judicial Branch this week announced it is expanding its remote capabilities. Among the expanded functions are:

Civil

*Non-arguable matters will be ruled on remotely and arguable motions marked ready will be scheduled for remote hearings on the record.

*Remote court trials are being scheduled and conducted.

*Individuals may apply for civil protective orders via email or fax.

Family

*Individuals may remotely request their divorce decrees.

*Parties with non-adversarial divorces may ask that those matters be approved without having to go to court.

*Virtual courtrooms are being set up to begin conducting limited hearings in Family Support Magistrate Matters.

Criminal

*A "nolle and prosecution declined" docket has been established. The docket is heard every Wednesday. Attorneys with appearances in the file will be notified through e-services.

*Family Services are conducting Assessment and Pre-Trial Supervision via telephone.

*Criminal Courts are conducting remote pre-trial conferences with a focus on cases in which a person is detained in custody on a pretrial matter.

Bar Exam Rescheduled

The Connecticut Bar Examing Committe recently announced that the bar exam scheduled for September 30 and October 1 has been canceled due to concerns of Coronavirus. The bar exam is now scheduled for October 5 and 6 and will be administered entirely remotely. Applications to take the bar exam are being accepted until 4:30pm on August 7, 2020. Which Connecticut Courthouses Will Be Reopening in July?

As part of the phased reopening of Connecticut courthouses after the Covid-19 shutdown, the following courthouses will be open to assigned judges and assigned staff on July 13, 2020, and will resume operations and be open to the public on July 20, 2020:

1. 172 Golden Hill St., Bridgeport;

2. 80 Washington St., Hartford;

3. 54 West Main St., Meriden;

4. 1 Courthouse Square, Norwich;

5. 300 Grand St., Waterbury;

6. 90 Washington St., Hartford;

7. 95 Washington St., Hartford; and

8. 69 Brooklyn St., Rockville.

Due to social distancing and other public health requirements, these courthouses will be staffed in the same, limited, manner by which all existing open courthouses and facilities are staffed.

Connecticut Department of Motor Vehicles Reopening

The Connecticut Department of Motor Vehicles has reopened. All in person services will require an appointment. New drivers and people registering new motor vehicles can now schedule an appointment at select DMV locations. Road tests have also resumed. New safety protocols have been put in place to ensure DMV worker and customer safety.

Carroll Message to BAR Through COVID Task Force

On June 8, 2020 Chief Court Administrator Patrick Carroll issued a letter to the CBA COVID 19 Task Force. It details the expanded days and hours of courthouse operation as well as the reopening of certain court houses throughout the State over the next few weeks. He discusses the implementation and training in new technology that will allow the court system to function safely in the weeks and months to come. Judge Carroll also confirms that no jury trials are expected to be held until at least September 1, 2020.

Reopening Phase 2

Governor Lamont recently announced the Phase 2 plan for reopening sectors of Connecticut’s economy.

Phase 2 which was originally scheduled for June 20 was moved up to June 17. Specific, detailed guidance was issued for nine different sectors including hotels, restaurants, libraries and gyms.

Payroll Protection Program (PPP) Reform Bill

On Wednesday night Congress passed a Payroll Protection Program (PPP) reform bill. The bill gives small business owners more flexibility and time to use the loan money and still qualify for loan forgiveness.

The PPP was initially passed as part of the CARES Act. The reform bill would extend the 8 week period in which businesses must use the money to qualify for forgiveness to 24 weeks. In addition the reform bill now allows small businesses to use up to 40% of the funds for business costs and 60% for payroll. The initial bill set the ratio at 25% business costs and 75% payroll.

Connecticut Judicial Department Update

Yesterday the Connecticut Judicial Department announced the additional steps they will be taking toward more fully reopening the state courthouses.

On June 8 the Torrington, Middletown and Rockville courts will open. These three courts will join the 6 courthouses that are currently open and conducting priority one business.

The Judical Department has implemented video conferencing technology that will allow the courts to conduct remote pretrials begining on June 6. These pretrials will focus on cases that were ready for disposition before the pandemic hit in addition to priority one business.

On June 15 all open courthouses will operate from 9am to 5pm on Monday and from 9am to 1pm on Tuesday through Friday.

On June 29 the courthouses in Danbury, Milford, Stamford and Danielson will open.

On July 6 all open courthouses will operate from 9am to 5pm Monday through Friday.

Throughout this process the courts will continue to focus on priority one business and cases that can be disposed of by way of remote pretrials and a remote sentencings.

As this process continues to develop we anticipate receiving additional information and guidance from the Juducial Department and will provide up dates as we know more. Attached is the memorandum from the Judicial Branch.

AEP Telehealth Evaluations

Reopening Phase 1

On May 20, 2020 Connecticut entered Phase I of reopening after the Covid 19 quarantine. Restaurants with outdoor dining; non-essential retail; museums and outdoor recreation were able to open if they follow specific guidelines intended to protect workers and customers. Hair salons are slated to open on June 1, 2020. Phase II of the reopening plan is schedule to begin on June 20 provided that the rates of Covid related infection and hospitalizations do not spike between now and then. Phase II includes bars, indoor activities and outdoor gatherings of up to 100 people. Phase III would begin 4 weeks after Phase II. Below is a graphic detailing the planned reopening phases. Application for Infrared Thermometers

The State of Connecticut has obtained 50,000 infrared thermometers for small businesses, nonprofits, and places of worship to support safe reopening activities amid the COVID-19 pandemic. One thermometer is available for each physical location of the entity.

The state has partnered with the C.B.I.A. and CONNSTEP to distribute the thermometers. They will available at the municipality where the business, nonprofit or place of worship is located.

Criminal Court Operations

Governor Lamont recently announced the first phase of easing the State of Connecticut Covid 19 quarantine restrictions. In light of that announcement, the State of Connecticut Judicial Branch is planning to expand court house operations effective May 27th. On that day 13 courthouses will be open and operational – 1 courthouse in each Judicial District. For locations with more than one courthouse in the district, the JD courthouse will reopen, while the other courts in the district remain shuttered. The 6 courts that are currently operating will continue to operate. As of this moment, the Judicial Branch is planning to maintaining a 3-days per week schedule for Mondays, Wednesday and Fridays, however, coinciding with the May 27th expansion, they are planning to transition their hours of operation to full court days (9-5) on all 3 days. Family Court Operations

The State of Connecticut Judicial Branch, in an attempt to respond to the Covid 19 emergency, has announced updates on how Family Court Matters will be conducted in the near future. The announcement is below.

“Effective the week of May 11, 2020, family pretrials and status conferences will be held telephonically. These remotely held events will be scheduled in cases from all Judicial District courts, whether or not the court location is currently open. Please check your E-Services inbox regularly for notices of these events. Any such notice will require you to send your preferred e-mail address to a designated court employee, who will then forward you instructions on how to access the conference.

DO NOT COME TO COURT FOR THE CONFERENCE. It will be conducted remotely.

All conferences will be accessed using Microsoft Teams, which you can download to your computer or mobile device from the internet at https://teams.microsoft.com/downloads.

Pursuant to the Governor’s Executive Order 7CC, the Judicial Branch is also taking requests for the entry of judgments by agreement, or for the approval of any final agreement, in divorces, legal separations or custody/visitation actions without a court hearing. Earlier this week Governor Lamont announced that the State of Connecticut will begin Phase I of reopening on May 20, 2020. This will be the beginning of a four phased approach to reopening the State of Connecticut operations, public spaces and private businesses that have been closed due to the Covid 19 pandemic. Each phase is based upon the successful completion of the previous phase. In addition, each phase has safety prerequisites that must be met to minimize the spread of the coronavirus. CARES Act Funding

A Second Round of CARES Act funding was passed this week.

In an ongoing effort to help small businesses that have been negatively impacted by the Covid 19 pandemic Congress passed and the President signed a second round of CARES Act funding earlier this week. The funding is intended to help small businesses struggling due to the coronavirus quarantine.

This second round of funding provided an additional $310 billion to fund the Payroll Protection Plan (PPP); $10 billion for administrative costs associated with the PPP; $60 billion for the Economic Injury Disaster Loan (EIDL) program and $100 billion for hospitals and coronavirus testing.

The new money will supplement the CARES Act funding passed earlier this month.

The CBA is expected to issue further guidance on how business can qualify for loan forbearance.

Face Mask Requirement

In an effort to combat the Covid 19 global pandemic Governor Ned Lamont issued Executive Order 7BB requiring face coverings or face masks be worn in public where close contact cannot be avoided. The State of Connecticut Judicial Website has posted that pursuant to that executive order, effective immediately no person is permitted to enter a Judicial Branch courthouse or facility without covering his/her mouth and nose with a mask or face covering.

I am supposed to go to court this next week but the courts are closed. What do I do?

Due to the Covid 19 pandemic the Connecticut Judicial Branch has closed all but 6 courthouses in the state. Those few courts are only open three days a week and for reduced hours. The courts are only handling arraignments from overnight arrests. All other cases are being issued continuances.

If you have a case pending during this Covid 19 quarantine period your case will NOT be proceeding. The court clerk's are continuing cases on a weekly basis as the initial court date approaches. Most courts are issuing the continuances at the end of the week before the originally scheduled court date.

Most cases are now being given new dates in mid-June or early July.

Governor Lamont's latest Covid 19 related executive order takes effect tonight, April 20, 2020, at 8:00. Starting at that time any person in a public place in Connecticut who is unable to or does not maintain a safe social distance of approximately six feet from every other person shall cover their mouth and nose with a mask or cloth face-covering.

In addition, individuals shall use a mask or cloth face covering when using the services of any taxi, car, livery, ride-sharing or similar service or means of mass public transit, or while within any semi-enclosed transit stop or waiting area.

The commissioner of the Department of Economic and Community Development will be required to update the previously issued Safe Workplace rules and Safe Store rules.

Nothing in this order shall require the use of a mask or cloth face covering by anyone for whom doing so would be contrary to his or her health or safety because of a medical condition, anyone under the age of 2 years, or by an older child if the parent, guardian or person responsible for the child is unable to place the mask safely on the child’s face.

If a person declines to wear a mask or face covering because of a medical condition as described above, such person shall not be required to produce medical documentation verifying the stated condition.

COVID-19 Residential Renter Protection

As part of the ongoing response to the Covid 19 pandemic, Governor Lamont recently signed an executive order intended to protect residential renters.

The order prohibits landlords from issuing evictions until July 1, 2020. It states that for any rent due in April 2020 landlords must grant tenants a 60-day grace period automatically and cannot charge late fees or interest. For rent due in May of 2020 landlords must grant tenants a 60-day grace period upon request and cannot charge late fees or interest. Landlords must allow tenants to apply any security deposit in excess of one month’s rent to their April. May or June rent.

During this unprecedented Covid 19 pandemic a number of measures have been instituted that may benefit our clients, friends, neighbors and families. Many of the measures can be accessed right now. Some measures are State specific and some are Federally backed. Below is a list of a few things that are currently available.

Access Health CT has extended the open enrollment period for any Connecticut resident who does not have health insurance. You can access their website at https://www.accesshealthct.com/AHCT/LandingPageCTHIX or call them at 1-855-365-2428
The State of Connecticut has worked with 9 of the 10 largest automobile insurance companies to apply a premium credit or rebate to all Connecticut drivers due to reduced driving during the Coronavirus pandemic. No action is need by consumers. The insurance companies will automatically apply the rebates or credit.
All federally backed mortgages (Fanny Mae, Freddy Mac, FHA, VA, etc.) are eligible for up to a 180 day payment deferment. This time line may be extended further in the future. Contact your lender to learn more.
Many Connecticut banks are offering small business mortgage relief if businesses are having trouble making their payments due to the Covid 19 pandemic. Contact your bank to discuss the options.
Businesses are eligible for a 100% refundable payroll tax credit for up to 80 hours of paid sick time for any employee that is dealing with Coronavirus related illness.
Anyone that had a Small Business Express loan before the Covid 19 pandemic is eligible for a three month payment deferment on those loans.
Commercial landlords can contact their banks or credit unions to discuss mortgage relief on an individual basis.
Connecticut Small Business Bridge Loans are still being processed with the hope that money will be disbursed by the end of April. There is talk of opening up another round of Bridge Loans in the near future.
PPP loans are starting to be accepted, processed and closed. Small local banks seem to be moving faster than the large national banks. The PPP application is available at https://www.sba.gov/sites/default/files/2020-04/PPP%20Borrower%20Application%20Form.pdf

Covid-19 Update

Congress recently passed the CARES Act which allows small businesses to apply for loans and/or grant's during the Covid 19 pandemic.

The two loans that have been discussed the most are the Payroll Protection Plan (PPP) and the Economic Injury Disaster Loan program. (EIDL).

The PPP is intended to loan small businesses money so they can continue to employ their workers during the Covid 19 crisis. The loan amount is calculated at 2.5x a typical month's payroll and expenses (rent, leases, mortgages, utilities, etc). To qualify a business must have fewer than 500 employees and their business has to have been negatively impacted by the Covid 19 pandemic. The full amount of this loan can become a grant if the employer, over the 10 week period of the loan, spends the money on the designated expenses (salaries, mortgages, rent, leases, utilities), does not fire/layoff any employees and keeps the employees compensation at no less than 75% of what it was before the pandemic. There is even a way for an employee to rehire laid off employees or catch up their wages so that the employer's PPP loan converts into a grant.

A small business can apply for the PPP through a local bank.

The EIDL is emergency money available for small businesses and since the entire country has been declared an emergency zone, every small business can apply! The first $10,000 of the loan does not need to be paid back. The SBA claims the money will be direct deposited in the business bank account within a few days of their application being granted. A small business that applies is assumed to be eligible. The initial $10,000 can be used for the same expenses as the PPP but then your PPP loan will be reduced by the $10,000 you received under the EIDL. The remainder of the loan money received is a low interest loan. A business can apply for the EIDL directly on the Small Business Association website at sba.gov

These loans are new or have been newly revised so there is still some confusion and delay in getting the money out to small businesses. If you have not applied yet, it is not too late! Get your application in today.

Personal Injury Case Settlement

A $1,350,000 settlement was reached in a motorcycle collision where the plaintiff was struck and killed by an oncoming vehicle that made an unexpected left turn in front of him. The 45 year old plaintiff suffered significant blunt force injuries and was pronounced dead at the local Hospital emergency department. The defendant was insured by Amica. Liability was contested and the plaintiff’s speed at the time of crash was a significant factor in the mediation. An appraisal of economic loss was prepared on the plaintiff’s behalf as was an accident reconstruction report. Total available insurance was $1,500,000. An admission, by its very nature, carries an enormous amount of credibility and weight, with investigators, as well as FAA attorneys, and administrative judges in later proceedings. Admissions are as close to silver bullets as legal evidence gets because they can carry multiple elements of the offense or violation the authority needs to prove.

49 C.F.R. 830.2 and 830.5 require reporting accidents and serious incidents to the NTSB. Reporting To the FAA in the context of manned aircraft accidents or incidents, however, is never required unless that pilot has deviated from the rules during an in-flight emergency and the FAA specifically requests a written report under 14 C.F.R. 91.3. Certain Unmanned Aircraft Systems accidents are reportable to the FAA under § 107.9.

Why Writing a Will is Important

According to polls done by nationally renowned financial journals, at least half of all adults don’t have a last will and testament. There are a few reasons for this, including the idea that making a will isn’t an urgent need or a will is simply unnecessary.

Of course, many people avoid writing a will because they don’t want to remember that they are mortal.

A will is necessary and you should write one as soon as possible. If nothing else, you can go back to ignoring death but rest assured that your wishes will be carried out.

Taking Care of the Kids

If you’re a parent of minor children, you need to write a will that defines who will raise your children should you be unable to do so. If you die intestate—with no will in place—the courts will determine who has custody of your children. A judge will evaluate information available but you are much more familiar with your friends and family. While a judge may consider that your brother already has two children and might be a good father, you may not want this option because you disagree with his methods of childrearing and would prefer your childless sister raise your children. Further there are issues beyond the age of majority which need to be considered such as creating trusts to protect young adults from making immature decisions.

Spreading Your Wealth

There are many movies in which the reading of a will is set in a plush library and the amounts distributed are thousands if not millions of dollars. You may feel that you don’t have any real money to spread around because you’re living paycheck to paycheck.

However, most people forget about assets that are easily forgotten, such as life insurance policies. Why think about money that will only appear after you’re gone from this world? If you are making premium payments, you are likely doing so to provide financial help to loved ones. If you want the money to go pay for your child’s college education, you will need to create a will to ensure that wish is carried out. Going back to our example, you may want your sister to raise your children but don’t trust her spending habits. You may want your brother to administer the estate to avoid her taking the kids on trips and buying them toys, depleting the college fund before they reach 18.

Issues for the living:

A medical power of attorney will appoint a healthcare agent so that you can choose who will act on your behalf if you cannot speak to your doctors about your own health choices. Think about your family members and how they might respond if a doctor presented them with options for treatment. Who would you trust to do what you would want done? A living will provides guidance to your loved ones and medical providers how you want them to treat you at the end of life. A Power of Attorney can empower your loved ones to continue to handle your legal affairs if you should need their help. These are just a few of the legal issues you can face during your lifetime.

Demystifying Living Wills and Powers of Attorney

There may come a time in your life when you cannot advocate on your own behalf because of physical or mental restrictions. While it’s not pleasant to think about such a possibility, there is a way to prepare and get peace of mind. You can create a series of legal documents that express your wishes so that you have a measure of control over your future.

Living Wills

A living will or advance healthcare directive describes how you want your doctors to treat you. Medical advances have meant great improvements in our health and ability to live longer; there are also more cases in which a person can be kept alive by artificial means, including feeding tubes and mechanical respiration.

There are some emotional or religious impacts to this kind of treatment and, of course, there are financial implications as well. By writing down your preferences in this area, you can relieve your family of several burdens. They will not be forced to guess at your intentions and they can feel confident about your wishes to spend money on such treatment. Without that information, they may be forced to deal with guilt, crippling medical bills, or gut wrenching decisions about your health.

In other cases, a stranger may make decisions for you. Without a written directive and no way to elicit a response from you, a judge may enforce state law to determine your health care decisions. Those choices may, or may not, be what you want for yourself.

Power of Attorney

This document can seem scary because it gives some of your authority to another person. The designated man or woman can act on your behalf in private affairs, business, or other legal matters. However, if there comes a time when you cannot act on your behalf, there are likely to be financial issues that complicate your life and the lives of those who care about you.

The good news is that having a Power of Attorney actually reinforces your independence. You can chose exactly the authority you want to share, and with whom, using a legal tool called a durable power of attorney.

Appointment of a Health Care Agent

There are several factors than can render you unable to discuss your condition with your doctor—age, disease, accident, or even anesthesia during a medical procedure. You can elect a person to speak on your behalf when you are unable to do so by appointing a health care agent. Without an agent in place, doctors and hospital staff may be prohibited by law from discussing your care or condition with anyone, including your loved ones.

A power of attorney can work with a living will and the appointment of a health care agent to increase the control you have over your decisions, who acts on your behalf, and what will happen to you.
